The point is that it's not the object we think it is, it's a representation. It's not even a painting of a stylus. It's a configuration of pixels arranged in a fashion to look like a stylus, only it's not real, it's flat, and it vanishes when you turn off the 3DS or switch to another image. The original idea was to make one think about what you're really looking at.

Whether or not this a stylus or a picture of a stylus, the real ones really arent styluses, there faluty so I'm glad the 3DSXL has regular styluses. Still a great picture.

I agree completely. It would be a good stylus if it could be locked into its full length and then retracted later. But without that feature it isn't worth the pain in the hands and head that it gives be, not to mention to the inferior game playing experience.
