Well...I will agree, For a public program, The Terms of service needs to be followed...or established..ESRB dosent seem to claim too much responsibility for online activity. Till then, I guess we just try to make sure we don't fall into bad crowds.

Nintendos got an Online Photo gallery alternative on their own site if your intristed. Personaly I don't see photography as being "art" but I'm sure they monitor the photos closely for questionable content.
